Court Cases

 A lot of our time and energy is put into answering calls on reported Cruelty Cases.

We allow the person reporting to remain anonymous  although we do like to have a phone number in case we have trouble finding the location of the animals in question. 

We answer reports of cruelty to Dogs, Cats, Horses or Ponies and even Farm Animals.

It is a very hard and often times sad job, but helping the animals in desperate situations can be very rewarding.

Cruelty to a Mare on 14th September 2009

We were successful in Thurles Court on Friday 11th January 2011.

Mr Dermot O Dwyer, Ironmills, Cappawhite, County Tipperary was found guilty in Thurles Court for cruelty to horses under the 1911 Protection of Animals Act and he was ordered to pay a 500 fine for this horse that had to be removed from his property on 14th September 2009

He just left this beautiful horse to die of starvation in a field where there were 30 other horses.

We acted on a call from a member of the public on 14th September 2009 that there was an horse in very bad condition that was hardly able to move, so we called a vet and the Guards Mr Dermot O Dwyer, Ironmills, Cappawhite, County Tipperary.

The mare had to be removed immediately on the Vets advice, we brought her down to the rescue while the Guards went up to the owners house to tell him of our findings and that he was to call down to me so I could advise him on some of the animals that needed attention, he came down the following day to me and surrendered her to Cottage Rescue and I gave him the advice that was need for the other animals, one in particular an adult chestnut mare all of which he agreed to do and to cut down on the amount of horse he had as he had no means to care for them.

Here are pics that we took of her when we got her back here to the rescue.

The above pics are what we call an emaciated horse (she was on a scale of 1 to zero, you can see the ribs, the back bone, the tail bone, no muscle and also the hollow under the tail, sunken hips, flanks not a pick of meat on the poor creature.

She had lots of rain scald which took ages to get off her so we had to get special washes and creams, vitamins, feed, Farrier and a special dentist for her teeth.

We decided to call her Justice as we wanted her previous owner to get the justice he deserved.

I was so disappointed that he got a fine of 500 and 6 months to pay it, I am angry that so many of these beautiful animals are suffering so much and this is what they get in court for it.

This horse was rescued on 14th September 2009 and the case did not come up until Friday 11th January 2011.

This pic was taken of Justice 28th November 2009 a few months after we took her in and we were delighted to see how far she had come on in such a short while.

We got great support from the following on her sad tale and I would like to thank them here.

Cruelty to Filly on 4th November 2009

Mr Dermot O Dwyer, Ironmills, Cappawhite, County Tipperary was found guilty in Thurles Court for cruelty to horses under the 1911 Protection of Animals Act and he was ordered to pay a 250 fine for this Filly that had to be removed from his property on 4th November 2009

He just left this beautiful horse to die of starvation.

Here we go again with the same man, Mr Dermot O Dwyer, Ironmills, Cappawhite, County Tipperary.

This poor filly was not being fed so we had to get a Guard’s and a Vet again about this young Filly, she was very nervous and was full of rain scald and Lice and a belly full of worms.

We named her Gypsy which we thought suited her quite well

We had no room at the rescue but a very kind friend Marion said she had extra stalls if we needed them so she went there for a while until we had room for her here.

                                        Here he is just before he went to his Long Term Foster Home down in County Clare.

We called this lovely New Forest Pony Echo, he had pretty bad wounds on his body which had become badly infected and no Vet treatment was sought for him!

He was removed from the owners property with the help of the local Garda and came into Cottage Rescue, the owner called a few days later and surrendered him to us.

It took three months to heal his wounds, they had to be hosed out with water every day, dressed and creams & sprays put on him, he was very nervous in the beginning as he was in so much pain and so sore but Echo got so good in the end, he was a darling.

He has gone to County Clare to a great friend of ours here in Cottage Rescue where he is with a couple of other horses on a farm to live with a lovely family who love him dearly and where he will never know CRUELTY ever again!

The owner was fined 500 for cruelty and  100. expenses, the Judge said he would put him in Jail but the laws were not with him on that and that if he ever comes before him again in Court for Cruelty again he will send him to jail……….

The Judge highly commended Cottage Rescue for our Voluntary work involved in Animal Rescue and Cruelty which we were delighted with!

So all in all it is good news all around for this lovely pony but sadly we were too late for the little white pony whose body we found in a ditch dead and decomposed.

We were successful in Thurles Court on Wednesday 25th April 2007.

A Cappawhite Man Mr Dermot O Dwyer, Ironmills, Cappawhite, County Tipperary was found guilty in Thurles Court for cruelty to horses under the 1911 Protection of Animals Act and he was ordered to pay a 600 fine. He had left this pony in a field with these horrific injuries for 3 weeks with no Veterinary  treatment.

A very concerned member of the public rang me about cattle that were dying and dead on a farm. So myself and 2 D.V.O. Vets and Guards went to the farm of Mr Tom Shine, Attykitt, Rosegreen, Cashel, Co Tipperary on 23rd November 2006 to find animals that had died of starvation and more had to be put down.

What can I say about these pictures???

    Nothing can be said to describe dead animals in a field like this.

But we can ponder on the PAIN, MISERY and SUFFERING they must have endured with no feed or fodder last winter which was a harsh one, electric fencing to keep them within this area with no grazing and the pain they must have Suffered and the Slow and Painful death due to starvation must have been horrific!

No animals should have to suffer like this….

There is no excuse for this type of CRUELTY!!!

Why would God make something so perfect
and leave it behind?
Some may think we are masters of the animals,
but the animals have mastered themselves. ..
something people still haven't learned.
War and abuse make me hurt for the world,
but a rescue that makes the news gives me hope for mankind.
We are a quiet but determined army and we are making a difference every day.
There is nothing more necessary than warming an orphan,
nothing more rewarding than saving a life,
no higher recognition than watching them thrive.
There- e is no greater joy than seeing a baby play who, only days ago, was too weak to eat.
By the love of those who I've been privileged to rescue,

I know what true unconditional love really is,
for I've seen it shining in the eyes of so many, grateful for so little.

We were successful in Cashel Court on Wednesday 16th of Jan 2008.

A Cashel Farmer Mr Tom Shine, Attykitt, Rosegreen, Cashel, Co Tipperary was found guilty in Cashel Court for cruelty to cattle under the 1911 Protection of Animals Act and he was ordered to pay a 2,600 fine.

He left 7 cattle to die of Starvation and a Weanling had to be Put Down and 4 more were Put Down a month later.

Here are some more court cruelty cases from years back that I dealt with.

I got a cruelty report about this dog in Thurles and met up with the Guards 15th of October 2003 and we removed her and 5 pups that she was trying to raise. The dog was very emaciated and had to spend 24 hours in the vets and I took the puppies from her so that she could begin to gain weight.

Mr Francis McGuire, 43 Butler Avenue Thurles, Co Tipperary was found guilty in Thurles Court in March 2004 for cruelty to animals under the 1911 Protection of Animals Act and he was ordered to pay a 150 fine.

The judge banned him from ever keeping animals again.

I responded to a call and on 25th February 2005. Both myself and a Guard and a DVO Vet arrived on the property of Mr Michael Murphy, Main Street, Ballinunty, Co Tipperary to find one dead calf buried under some plastic bags and another in a shed dying on the floor with 4 other calves clambering over her, she was immediately put down by the Vet.

Owner was found guilty in Thurles Court in 2006 for cruelty to animals under the 1911 Protection of Animals Act and he was ordered to pay a 50 fine.

I called to Mr Billy & John, Toor, Newport, Co Tipperary on the 16th October 2005 with a Vet and a local Guard to find this pony in a dreadful state in a bog field behind the owners house. This pony was left in this state with no shelter, bedding and no evidence of food or water.

The pony had fallen into a drain 7 days previous and had been in the drain for a day or two, he got a neighbour to drag the pony from the drain with a machine into the middle of the field and his excuse for leaving her in this condition for over a week was because he was waiting for the local man to collect the pony and that this man would put the pony down and feed it to his dogs. This poor animal was left  to die for over a week in agonising pain with no proper bedding, feed or water or shelter.

The Vet put the pony down that day as she was not able to get up and she possible had a spinal injury,.

Owner was found guilty in Court in 2006 for cruelty to animals under the 1911 Protection of Animals Act and he was ordered to pay a 500 fine.

I went to visit the farm of John Ryan, Barnagore, Dolla, Nenagh, Co Tipperary 3rd January 2005 with Vet and a Guard to find this horse in a dreadful condition.

He had been hobbled, a front foot ties to the back foot which is what caused all this damage. This poor animal was hobbled and ties in a corner of the field and he could not get to grass and he had been shod as recently as 3 months before we rescued him.

Sadly he had to be put down 7 days after I rescued him as he was gone too far to save despite all efforts from us and the vets.

Owner was found guilty in Nenagh Court in 2006 for cruelty to animals under the 1911 Protection of Animals Act and he was ordered to pay a 1,000 fine.

You can see how emaciated this poor horse is and also the horrific wounds on his legs from being hobbled.

I and a vet and a guard attended a farm that was owner by Mr Michael Bitts, Curraleilgh, Ballyporeen, Co Tipperary, on 27th August 2005, he lived in Carrickaline, Co Cork and nobody lived on the farm and he came up every few days to tend the animals.

We were horrified to see the living conditions of 26 dogs including a few puppies. There were Golden Retrievers, Labradors and a couple of Westies. There was no food present, some had water others had not and some had very dirty water to drink, most of the dogs were chained up in corners of dark sheds with no ventilation or light, sheds were in a very dirty filthy condition with dog faeces all over the floors, there was no bedding for the dogs and a few dogs were chained up outside with no shelter, food, water or bedding. I had to remove 11 dogs that day on Veterinary advice and a Westie had to remain in the vets for the night.

I had organised for the donkey sanctuary to remove a donkey mare that was in foal and the ISPCA to take some of the dogs and Irish Retriever Rescue to take on the Retriever dogs & pups dogs as we had no room here at the rescue for them all, we removed all fowl which included: 7 geese  (two of which had broken wings) 15 ducks (one had a very badly broken beak) 3 Bantams and a 3 legged ewe.

53 animals in total were removed from the farm within 2 days.

Owner was found guilty in Nenagh Court in 2006 for cruelty to animals under the 1911 Protection of Animals Act and he was ordered to pay a 2,400 fine.

Owner had hacked off the hooves off the donkey the following morning.
